Re: Recommendation to Mayor and Board of Supervisors to approve purchase of 380 Bacon St (a portion of the Martin Luther King, Jr., Middle School site) for Portola Branch Library

I am very pleased to bring this recommendation to the Library Commission for the purchase of 380 Bacon St. as the site for the Portola Branch Library. I would like to recap the history of this site acquisition process for your information.
- August 7, 2001 Library Commission authorized Real Estate to investigate 4 possible sites for the Portola Branch, including this site.
- May 16, 2002 Library Commission authorized Real Estate to enter into negotiations for the Bacon St. site, with the Boys and Girls Club on San Bruno Ave. as a back-up site.
- November 12, 2002 San Francisco Unified School District Board agreed to sell the property to the City and authorized the Superintendent to complete the transaction
- January 16, 2003 Library Commission approved a resolution urging the Board of Supervisors to approve a joint-use cooperative agreement with the City and the San Francisco Unified School District
Staff is recommending that the Commission approve the attached resolution urging the Board of Supervisors to approve the purchase of 380 Bacon St. as the site of the Portola Branch Library. This site is an excellent location and is supported by the community.
The site purchase price of $1,287,000 is within the project budget. The Portola Branch was one of the projects that was included in the architectural competition held earlier this year. The firm selected from the competition to design the Portola Branch Library is the joint venture of Stoner Meek/Noll & Tam; and the contract is currently being negotiated.

Also attached is a term sheet that outlines the key points of the purchase and sale agreement. The complete document is available for review in the Office of the Commission Secretary.
Staff is preparing an application for Proposition 14 funds for this highly competitive project to be submitted to the California State Library in January 2004.

RESOLUTION endorsing acquisition of REAL PROPERTY LOCATED AT 380 Bacon Street
FOR THE Portola BRANCH LIBRARY AND URGING BOARD OF SUPERVISORS and mayor TO
APPROVE PURCHASE AND SALE documents
WHEREAS, on November 7, 2000, the voters of the City and County of San
Francisco passed Proposition A, "Branch Library Facilities Improvement Bonds,
2000" for general obligation bonds in the amount of $105,865,000 for the
acquisition, renovation and construction of branch libraries and other library
facilities; and
WHEREAS, one priority of the Branch Library Facilities Improvement Bonds is to
relocate the four branch libraries located in rented facilities into facilities
owned by the City; and
WHEREAS, the Portola Branch library presently is housed in a facility rented by
the City at 2450-60 San Bruno Avenue that is inadequate to meet the long term needs
of the neighborhood it is intended to serve; and
WHEREAS, at meetings of the San Francisco Public Library Commission ("Library
Commission") held August 7, 2001 and May 16, 2002, the Library Commission authorized
the City Librarian and the Department of Real Estate to investigate, with the intent
to purchase as a library site, property owned by the Sna Francisco Unified School
District adjacent to the Martin Luther King Middle School (the “Property”), which is
an approximately 8,800 square foot (110’ X 80’) parcel of land, with an anticipated
street address of 380 Bacon Street; and
WHEREAS, The Department of Real Estate, on behalf of the Library Commission and the
City, has negotiated the form of an agreement to purchase the Property (the “Purchase
Agreement”) for One Million Two Hundred Seventy Seven Thousand Dollars ($1,277,000),
subject to the conditions described in the Purchase Agreement, and a subordinated
purchase option in favor of the seller (the “Subordinated Purchase Option”)(Purchase
Agreement and Subordinated Purchase Option together referred to as the “Purchase
Documents”), copies of which are on file with the Library Commission; and
WHEREAS, The Purchase Documents are subject to the prior approval of the Board of
Supervisors and Mayor, and all planning and environmental review pursuant to the San
Francisco General Plan, Section 101.1 of the Planning Code, and the California
Environmental Quality Act (CEQA) required for the City to purchase the Property shall
be completed prior to submission of the Purchase Documents to the Board of Supervisors
and Mayor for approval; now, therefore, be it
RESOLved, That the Library Commission endorses the purchase of the Property on the
terms and conditions set forth in the Purchase Documents and, subject to completion of
all required environmental review and governmental approvals pursuant to the San
Francisco General Plan, Section 101.1 of the Planning Code, and the California
Environmental Quality Act (CEQA), urges the City’s Board of Supervisors and Mayor to
approve the Purchase Documents; and be it
FURTHER RESOLVED, That the Library Commission authorizes the City Librarian and the
Director of Property to enter into any additions, amendments or other modifications to
the Purchase Documents that they determine are in the best interests of the City, do
not materially decrease the benefits to the City, and do not materially increase the
obligations or liabilities of the City, such determination to be conclusively evidenced
by the execution and delivery of any such additions, amendments, or other modifications;
and be it
Further RESOLVED, that, should the Board of Supervisors and Mayor approve the Purchase
Documents, the Library Commission authorizes the City Librarian and the Director of
Property to take all steps necessary to execute, deliver and perform all of the City’s
obligations under the Purchase Documents in accordance with their terms, and to acquire
the Property; and be it
FURTHER RESOLVED, That, should the Board of Supervisors and Mayor approve the Purchase
Documents, the Library Commission authorizes the City Librarian and the Director of
Property to take all steps that are necessary or advisable to complete the transaction
contemplated in the Purchase Documents, to effectuate the purpose and intent of this
Resolution, and that do not materially increase the obligations or liabilities of the
City; and be it
FURTHER RESOLVED, That all actions previously taken by any City and County of San
Francisco official in connection with the Purchase Documents are hereby ratified,
approved and confirmed by the Library Commission.
